Perpetual Sales Litigation

Wexler Boley & Elgersma is currently investigating claims against several companies who conduct perpetual “sales,” thus misrepresenting the actual price of their products or services.  These companies, including Legacy Box, Shutterfly, and others, advertise themselves as having retail prices in some cases 60% higher than their “sales” price, yet they never offer their products at those retail prices.  Consumers are thus enticed by the prospect of a “sale” when, in fact, the “sale” price never really changes and thus constitutes the actual retail price. The bottom line is that there is no sale, though the faux presence of one is used to mislead consumers into thinking they are buying at substantial discounts when they are not.
